Important

The Board of Managers recently became aware of two construction projects that were undertaken and completed without review and approval by the Board. In both cases, there appeared to be either Covenant or Design & Construction Guideline violations. The Board is placed in a difficult situation by not having participated in the consideration of these projects before they were built.

As most of you know, the Board has broad legal authority and responsibility to enforce our rules and regulations. The Board can insist that an out-of-compliance project be removed at the owner's expense. The Board can pay for a contractor to go on to a property and correct the violation and charge the property owner for the expense. The Board can impose a fine on an owner for not following the rules. None of these actions are appealing to the Board. We much prefer to work with owners in advance of a project to ensure that it is constructed in compliance with the Covenants & D&C Guidelines.

After considerable discussion on what to do about these cases, the Board is sending this letter to all members reminding you of your responsibility to seek approval for projects prior to construction. Projects requiring approval include new construction, remodels, additions, significant repairs and changes to landscape. If our Covenants and D&C Guidelines are unclear in any way, please seek a clarification in advance. Ignorance of the Covenants and Guidelines is not an acceptable excuse.

The Board has adopted a policy for situations where unauthorized construction is performed. Effective immediately, the Board will consider a fine for the violations. This fine will vary in amount based on the scope of the violation. We hope that the possibility of a fine, as well as the possibility of having to remove completed projects, will result in the elimination of this problem.

Since we have not mentioned this fining policy in the past, we think it only proper to give advance notice. If anyone has any questions on this policy, or suggestions how to eliminate non-approved projects in the future, please let us know.

MLPC Annual Meeting
The 2006 Annual Meeting of MLPC was held on Wednesday, July 5th at 7:00 PM at the Queen of All Saints Hall in Crested Butte. The minutes of the meeting are included with this newsletter. MLPC Board of Managers Election
David White, Lara Moscatelli and Andrew Shoup were elected for two year terms to the MLPC Board of Managers. They join Ron Baker, Gabi Prochaska, Chuck McGinnis and Bill Ronai who have one more year to serve of their term. At its first meeting, the new Board elected the following slate of officers:

Curt Wilker retired from the Board of Managers, effective at the Annual Meeting although he remains active on the CIP project. We appreciate his dedicated service to the community and his leadership on the Capital Improvement Project.

The Board continues to meet on a bi-monthly meeting schedule planned for the third Thursday of every other month beginning with the September meeting.

Capital Improvement Project Status

It's been over three years since the Capital Improvement project was first conceived. This summer brought the long anticipated paving of our interior roads. The community threw a pizza party for the road crew who worked very hard on behalf of our community. party to celebrate the paving effort

While not directly financed by MLPC, the paving of Washington Gulch Road by Gunnison County is crucial to the overall success of the CIP initiative. Work began in late June to prepare the road for paving. Water was diverted from the road and several blind curves were improved. Finally, the paving occurred. Mud season will be a bit less onerous to our community in the future!

Nearly 40 members of our community hosted a "thank you" pizza party for 30 Gunnison County road employees on August 9th.

Work on the interior roads has been initiated. The county maintains all MLPC roads with the exception of the road across the dam and the road serving the homes on the west side of the dam. The MLPC road paving agreement with the county stipulates that the cost-sharing portion of our CIP project also excludes these roads. The Capital Improvement Project therefore budgeted separately for their paving.

We obtained the State of Colorado permit to pave across the dam sooner than expected. This event enabled us to negotiate very favorable terms for the paving of the dam and the roads on the west side of the dam. This part of the project has therefore been completed nearly a year ahead of schedule. The remaining interior roads of the subdivision will be paved next summer as originally scheduled

The finances of the CIP are held completely separate from MLPC's operating account and capital projects account. If we maintain our favorable spending status through the paving stage of the project, there will likely be a surplus in the CIP account. If that is the case, the board will submit proposals for the use of those funds to the membership. Of course, one use of the funds could be in the form of a rebate to the members. The greatest cost uncertainty at the present time is the cost of materials (oil) in 2006. At this time, we remain confident that we have adequate budget and reserves to handle even further increases in the cost of oil.

Weed Management

Melanie Rees has been hard at work organizing and executing the subdivision's weed abatement program. Using volunteers and some hired help, she has led a frontal assault on our weed population using a combination of old fashion "pulling" as well as some focused spraying of herbicides. We extend a grateful "thank you" to Melanie and her helpful neighbors.

Cattle Fencing

As noted in an earlier newsletter, cows visited our community with increased frequency last fall. It is our responsibility to keep the cows out, not the rancher's.
In an effort to resolve the cow problem, the Board approved fencing the remaining open boundaries of MLPC. That fencing installation has been completed.

Every spring and early summer we sponsor a workday to patch our remaining aging fence-lines. Turnout was very poor for the work day. The burden of fence repair fell on the back of a few dedicated members of the community. They spent numerous hours working on the fence and the cow problem seems to have been addressed for one more year.

It is evident that the turnout for the volunteer work day is not meeting the needs of the community. Therefore, it is likely that we will budget for outside labor to do the fence mending next year.

Some Final Thoughts

Many driveways were paved this summer. If you plan to pave yours and it crosses a culvert, please ensure that the culvert is fully operational. This action may avoid possible costly remediation when the main roads are paved.

Many members are also making substantial investments in landscaping. Please remember to keep landscaping away from the road easement. The County snow plowing efforts make full use of the easements and they are not responsibility for damage to landscape features resulting from their plowing efforts.

Also, snow storage from your drive and decks must stay on your property. In the past, when the community was less developed, many people simply plowed snow from their drive onto the vacant lot across the street. Now, many of those lots are no longer vacant. Be a good neighbor and instruct your snow removal contractor on the proper location to place your snow.
